General Terms

1- These Terms & Conditions ("Terms") govern all bookings and participation in workshops and events organised by Ari Rex – Photographer.

​

The Terms are governed by the laws of Australia.

If any provision is found invalid or unenforceable, the rest shall remain in full effect.

Participation is voluntary and acceptance of these Terms is required upon booking.

​

2- Assumption of Risk and Waiver of Liability

​

Participation in photography workshops involves inherent risks, including but not limited to:

Slips, falls, uneven or rugged terrain, and environmental hazards.

Exposure to extreme weather (rain, wind, lightning, temperature extremes).

Wildlife encounters including insects and animals.

Malfunction or misuse of photography or outdoor equipment.

Travel-related risks including road transport.

Limited or delayed access to medical care, especially in remote areas.

By booking and participating, you acknowledge and voluntarily assume all such risks. You warrant you are physically and mentally fit to participate. You release and hold harmless Ari Rex – Photographer and affiliated persons ("Released Parties") from any liability for injury, damage, or loss, whether caused by negligence or otherwise.

3- Insurance

​

Insurance is NOT included in workshop fees.

Participants should obtain their own travel, medical, personal accident, and equipment insurance.

Ari Rex – Photographer is not responsible for any claims or costs related to injury, illness, loss, or theft.

Ari Rex – Photographer holds $20 million public liability insurance and operates all workshops with the necessary permits for the locations used.

4- Booking, Payment, and Cancellation

​

Booking & Payment:

Bookings confirmed upon receipt of full payment.

For invoiced workshops, the deposit is strictly non-refundable under any circumstance, but it is transferable to another participant or future workshop date with prior notice and approval.

Cancellation by Participant:

More than 28 days (4 weeks) before the workshop: Refund minus 10% admin fee.

Within 21–28 days before the workshop: 50% cancellation fee.

Within 14 days before the workshop: No refund unless otherwise agreed.

Note: Multi-day workshops (such as the Two-Night Milky Way Workshop) are fully inclusive of accommodation and catering booked in advance, and follow separate, extended cancellation terms stated on their individual workshop page.

Rescheduling:

Not permitted within 14 days of workshop.

Requests outside this period subject to availability.

​

Cancellation by Ari Rex – Photographer:

Workshops may be altered or cancelled due to weather, instructor illness, safety, or other unforeseen events.

Full refunds or credits for future workshops will be offered for cancellations.

No refunds if cancellation occurs partway through; participants may be offered a future make up session free of charge.

5- Code of Conduct

​

Participants must behave respectfully and safely at all times.

Disruptive, disrespectful, or unsafe behaviour may result in removal from the workshop without refund.

​

6- Equipment and Personal Responsibility

​

Participants must bring their own camera gear and suitable clothing (although hiring equipment is possible during booking or by requesting here.)

Follow all safety instructions and guidelines.

Ari Rex – Photographer is not liable for loss, damage, or theft of personal equipment.

Any gear or equipment hired from Ari Rex that is damaged due to the participant's negligence must be repaired or replaced at the participant's expense. The participant is fully liable for any such damage or loss.

7- Accessibility and Medical Conditions

​

Workshops may involve hiking, standing for extended periods, or exposure to outdoor elements.

Participants must disclose any relevant medical or physical conditions upon booking.

​

8- Intellectual Property and Copyright

​

Workshop materials remain the intellectual property of Ari Rex – Photographer.

Participants retain full copyright of photos they take during the workshop even if they hire Ari's cameras.

Materials may not be reproduced or shared without explicit permission.

9- Media Release and Opt-Out

​

By default, you consent to photos or videos taken of you during the workshop being used for promotional and marketing purposes.

If you do NOT consent, please notify Ari Rex in writing before the workshop to be excluded from any media.

10- Force Majeure

​

Ari Rex – Photographer is not liable for delays, cancellations, or failure to deliver services due to events beyond control (natural disasters, pandemics, government restrictions, etc.).

​

11- Minimum Numbers

​

Some workshops require a minimum number of participants to proceed.

If minimums are not met, workshops may be cancelled or rescheduled, with full refunds or credits offered.

​

12- Travel and Accommodation

​

Travel and accommodation are NOT included unless explicitly stated.

Participants are responsible for their own arrangements and assume any associated risks.

​

​

13- Weather Policy

​

Workshops proceed rain or shine. If heavy cloud, rain, or storms prevent Milky Way photography, the workshop continues indoors, covering all essential techniques and settings to ensure participants are fully prepared for clear skies in future.

Participants affected by weather may be offered a complimentary make-up session on dates to be advised, subject to availability.

Weather is unpredictable and outside our control. The indoor session is considered a valid and valuable part of the workshop, providing genuine learning value, and does not constitute grounds for a refund.

14- Drone Use

​

Drones are only permitted with prior approval and must be operated legally and safely.

Participants are responsible for any damage or fines resulting from drone use.

​

​

15- COVID-19 and Public Health

​

Workshops may be affected by current public health restrictions or requirements.

Participants agree to comply with all relevant health guidelines and protocols.

Refunds or rescheduling options will be offered if workshops are cancelled or postponed due to COVID-19 or similar public health emergencies.

17- Special Requirements and Dietary Needs

​

Notify Ari Rex at least 14 days prior to the workshop of any dietary restrictions, allergies, or other special requirements.

Efforts will be made to accommodate requests but cannot be guaranteed.

18- Emergency Contact

​

Participants must provide emergency contact details at the time of booking.

This information will only be used in case of emergency.

​

​​

19- Minors and Parental Consent

​

Participants under 18 years old must have written consent from a parent or legal guardian.

Minors must be accompanied by an adult unless otherwise agreed.

​​

​

20- Privacy Policy

​

Personal information collected is used only for booking, communication, and emergency purposes.

Information will not be shared with third parties without consent except as required by law.

21- Testimonials and Feedback

​

Participants may be asked to provide feedback or testimonials.

Unless otherwise requested, testimonials may be used for marketing purposes.

22- Dispute Resolution

​

Any disputes should first be resolved informally by contacting Ari Rex.

If unresolved, disputes may be referred to mediation or arbitration under Australian law.

​

​

23- Participant Agreement

​

By booking a workshop with Ari Rex - Photographer, you confirm that you:

Have read, understood, and agree to all Terms & Conditions.

Accept and assume all risks involved.

Waive liability claims against Ari Rex and Released Parties.

Agree to comply with workshop rules and safety instructions.

Understand this agreement is legally binding.
